Welcome to Healing Arts with Janet (“we,” “us,” “our,” or the “Practice”). These Terms & Conditions (“Terms”) govern your access to and use of the website located at healingjanet.com (the “Site”) and any related services, including virtual (telehealth) therapy services. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Our Services

Healing Arts with Janet provides mental health counseling, psychotherapy, and art therapy services delivered virtually (telehealth) to clients physically located in the States of Texas and Illinois, where our clinician is licensed. Services are provided by Janet Dowell, Licensed Clinical Social Worker (LCSW) — Texas License #59264 and Illinois License #149.030480 — and Certified Art Therapy Practitioner.

Use of this Site does not by itself create a therapist-client relationship. A therapist-client relationship is established only after you complete our intake process, sign the applicable consent and treatment agreements, and are accepted as a client.


2. Not for Emergencies

Our Site and telehealth services are NOT intended for medical or psychiatric emergencies. If you or someone else is experiencing a life-threatening emergency, a mental health crisis, or thoughts of self-harm or harming others, do not use this Site. Instead:

  • Call 911 or go to your nearest emergency room; or

  • Call or text 988 to reach the Suicide and Crisis Lifeline.

We do not provide crisis or emergency services and cannot guarantee an immediate response to any communication.


3. Eligibility and Location Requirements

To receive services, you must:

  • Be physically located in Texas or Illinois at the time of each session;

  • Be an adult (18 or older), or a minor who meets the applicable state-law requirements for consent to treatment and/or who has parental or guardian consent as required (see Section 4); and

  • Provide accurate, current, and complete information during intake and use.

We reserve the right to verify your location and eligibility and to decline or discontinue services if requirements are not met or if telehealth is not clinically appropriate for your needs.


We provide services to both adults and minors (teens). Consent requirements differ by state:

  • Illinois: Under 405 ILCS 5/3-550, a minor 12 or older may request and receive outpatient counseling or psychotherapy without parental consent, subject to statutory session limits and clinical judgment before a parent/guardian is involved.

  • Texas: A parent or legal guardian generally must consent to treatment of a minor, except in the limited circumstances specified by the Texas Family Code in which a minor may consent to their own care.

By using the Site or requesting services on behalf of a minor, you represent that you are the minor’s parent or legal guardian with authority to consent (where such consent is required), or that the minor otherwise qualifies to consent under applicable state law. Additional consent and treatment agreements will be required before services begin.


5. No Medical Advice; Informational Content Only

Any general information provided on the Site (such as blog posts, resources, or educational materials) is for informational purposes only and does not constitute medical, psychological, or professional advice, diagnosis, or treatment. Reliance on any information on the Site is at your own risk. Always seek the advice of a qualified health professional with any questions about your health.


6. Telehealth Acknowledgment

Telehealth involves the delivery of health care services using electronic communications. You acknowledge that:

  • Telehealth may not be appropriate for all conditions, and your clinician may determine that in-person care or a referral is necessary;

  • Technical failures, connectivity issues, or interruptions may occur;

  • There are potential risks, including limits on the clinician’s ability to fully assess you remotely and risks to the confidentiality of information transmitted electronically; and

  • You will complete a separate, detailed Informed Consent to Telehealth as required by Texas and Illinois law before treatment begins.


7. Appointments, Fees, and Cancellations

  • Fees, accepted payment methods, and insurance policies are provided during intake.

  • Payment is due at the time of service.

  • Our cancellation and no-show policy requires at least 24 hours’ notice; late cancellations or missed appointments may incur a fee equal to the full session rate. [ADJUST IF DESIRED]

  • Please refer to your signed client agreement for the controlling financial terms.


8. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;

  • Impersonate any person or misrepresent your identity, age, or location;

  • Attempt to gain unauthorized access to the Site, client portal, or any systems;

  • Transmit malware, spam, or harmful code;

  • Interfere with the operation or security of the Site; or

  • Copy, reproduce, or distribute Site content without authorization.


9. Client Portal and Communications

If we provide a secure client portal, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Do not share your credentials. Notify us immediately of any unauthorized access. Communications sent through unsecured channels (such as standard email or text) may not be secure; use the portal for sensitive information where available.


10. Intellectual Property

All content on the Site, including text, graphics, logos, and materials, is owned by or licensed to Healing Arts with Janet and is protected by intellectual property laws. You may not use our content without our prior written permission, except for personal, non-commercial use of resources we make available for that purpose.


The Site may integrate or link to third-party services (such as telehealth video platforms, scheduling, or payment processors). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services or content.


12. Privacy

Your use of the Site is also governed by our Privacy Policy and, with respect to your protected health information, our Notice of Privacy Practices, which are incorporated into these Terms by reference.


13. Disclaimer of Warranties

The Site is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free. This Section does not limit any warranties or protections that cannot be excluded under applicable law, and it does not alter the professional standard of care applicable to clinical services.


14. Limitation of Liability

To the fullest extent permitted by law, Healing Arts with Janet and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability arising from the provision of professional clinical services or gross negligence or willful misconduct.


15. Indemnification

You agree to indemnify and hold harmless Healing Arts with Janet and its owners, employees, and contractors from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site or violation of these Terms, to the extent permitted by law.


16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Collin County, Texas, and you consent to that jurisdiction and venue. 


17. Changes to These Terms

We may modify these Terms at any time. The “Last Updated” date reflects the most recent revision. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.


18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
